Wills and Estate Questionnaire

Do you have a Will which is valid? Yes No
It is clear and concise complying with the legal formalities. Today we have to be aware of the potential for challenges and claims to our estate. If you wish to give your estate to your beneficiaries in the manner and on the terms and conditions that are best you need a Will. (Don't Die for the Tax Man)
There are also a number of things that can affect your Will and require a revision. For example: consider the following questions.
(i) Changes in your personal life
Have you remarried? Yes No
Has there been a marriage, divorce, separation or death of any beneficiary? Yes No
Have you or your beneficiaries had any additional children? Yes No
If you have been divorced, have you had an opportunity to consider possible claims on the estate and plan for them? Yes No
Have you or any other beneficiary changed their name? Yes No
Has any person chosen as a co-executor become unsuitable? Yes No
(ii) Changes in assets
Have you recently given one of your beneficiaries funds or assets you want them to keep? Yes No
Have you recently acquired or disposed of any real estate or other CGT assets? Yes No
Have the asset values changed in such a way that they will affect the value of gifts under the will? Yes No
Have you sold any asset that was the subject of a particular gift? Yes No
(iii) How are your assets currently held?
Have you established a family trust or company structure since drafting a will and does your current will adequately deal with the administration and any disposal of assets? Yes No
Have you considered the use of a testamentary trust to either protect a particular member of the family or provide some financial advantages? Yes No
Do you have any assets held in joint names? Yes No
If yes, does the taxation treatment of these assets deemed to be held as Tenants-in-common require re-thinking how to best distribute or hold these assets? Yes No
Finally, have you ensured the SPR (sole or principle residence) exemption will be passed on? Yes No
